We operate this website and online store, including all related information, content, features, tools, products, and services made available to you. Our online store is powered by Shopify, which enables us to provide these services.

These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and Purchase Options Cancellation Policy, describe your rights and responsibilities when using our website, purchasing our products, or interacting with our services.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

We make reasonable efforts to describe and display our products accurately. Because our products contain natural food and botanical ingredients, variations in color, aroma, flavor, texture, and appearance may occur between batches and do not necessarily indicate a defect.

Product descriptions, ingredient information, suggested uses, and other information provided through the Services are for general informational purposes. Always read the product packaging and ingredient list before use. You are responsible for determining whether a product is appropriate for you, including considering allergies, sensitivities, medications, pregnancy, nursing, and existing health conditions. Consult a qualified healthcare professional when appropriate.

Information provided through the Services is not medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease. Individual experiences and results may vary, and we do not guarantee any particular outcome from using our products.

We reserve the right to modify product ingredients, formulations, descriptions, prices, availability, or packaging when reasonably necessary and to discontinue products at any time. Material formulation or labeling changes will be reflected in the product information made available at the time of purchase.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Space of Love Foods reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Space of Love Foods confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Space of Love Foods may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 – PRICES, BILLING, AND SUBSCRIPTIONS

Prices, discounts, and promotions are subject to change. The price charged will be the price displayed at checkout when the order is submitted. Unless otherwise stated, displayed prices do not include shipping charges, taxes, customs duties, or other applicable fees.

You agree to provide current, complete, and accurate billing, payment, shipping, and account information. You represent that you are authorized to use the payment method provided and agree to pay all charges associated with your order.

One-time purchases are charged once at checkout.

Subscription purchases automatically renew at the delivery frequency selected during checkout unless paused, skipped, or canceled. By purchasing a subscription, you authorize us and our payment processors to charge your saved payment method for each recurring order, including applicable shipping charges and taxes.

The price, discount, billing frequency, and other subscription terms will be displayed before you complete checkout. If we make a material change affecting future recurring orders, we will provide notice as required by applicable law.

Unless otherwise stated, subscriptions have no minimum commitment and may be paused, skipped, or canceled before the next order is processed through the Manage Subscription link in your customer account or subscription emails. Changes made after an order has already been processed may not apply to that order.

If a recurring payment cannot be completed, we or our subscription provider may retry the payment, request updated payment information, pause the subscription, or cancel it.

Promotional discounts apply only according to their stated terms and may not apply to every recurring order unless expressly indicated.

SECTION 5 – SHIPPING AND DELIVERY

Orders are processed and shipped according to the timeframes described in our Shipping Policy. Shipping rates, available delivery methods, and estimated delivery times are displayed at checkout.

Delivery dates are estimates and are not guaranteed. Delays may occur because of carrier operations, weather, customs processing, incorrect or incomplete addresses, or other circumstances outside our reasonable control.

If we cannot ship an order within the timeframe stated at purchase, we will provide notice and any options required by applicable law. Customers may be entitled to agree to the delay or cancel the unshipped order for a refund.

Please review your shipping address before submitting an order. Contact us promptly if a correction is needed. We cannot guarantee that an address can be changed after an order has entered processing or been transferred to the carrier.

If an order arrives damaged, contains incorrect items, or appears lost, contact us at hello@spaceoflovefoods.com. We will reasonably assist with investigating the shipment and determining an appropriate resolution consistent with our Shipping Policy and Return and Refund Policy.

International customers are responsible for customs duties, import taxes, brokerage charges, or other destination-country fees unless those amounts were collected during checkout.

Nothing in this section limits any consumer rights that cannot legally be waived.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Space of Love Foods, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws. 
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Space of Love Foods, Shopify or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Space of Love Foods. 
Space of Love Food's names, logos, product and service names, designs, and slogans are trademarks of Space of Love Foods or its affiliates or licensors. You must not use such trademarks without the prior written permission of Space of Love Foods. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners. 

SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Space of Love Foods is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Space of Love Foods. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Space of Love Foods, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Space of Love Foods. 

SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our privacy policy for more details on how we, Shopify, and our partners use your personal information.

SECTION 11 – FEEDBACK, REVIEWS, AND CUSTOMER CONTENT

If you submit a review, testimonial, photograph, video, suggestion, comment, or other content to us or through the Services (“Customer Content”), you represent that you created it or have permission to share it and that it does not violate another person’s intellectual-property, privacy, publicity, or other legal rights.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt, and share Customer Content for operating, improving, and promoting Space of Love Foods, including through our website, emails, social media, advertising, and printed materials. You retain ownership of your original Customer Content.

Reviews and testimonials must reflect genuine experiences and honest opinions. You may not submit content that is knowingly false, misleading, unlawful, threatening, defamatory, obscene, discriminatory, infringing, or intended to manipulate product ratings.

If you received a discount, free product, payment, reward, or other incentive connected with your review or testimonial, you must clearly disclose that relationship.

We may moderate, decline to publish, or remove Customer Content that violates these Terms or applicable law. We are not obligated to use, publish, compensate you for, or respond to submitted Customer Content.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with the these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Space of Love Foods, Shopify or users of the Services, or expose them to liability. 
In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Services; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

SECTION 14 – AUTOMATED ACCESS AND AI AGENTS

Automated tools, bots, scrapers, and AI agents may access or interact with the Services only through methods permitted by us, Shopify, or an approved integration and in accordance with these Terms.

Automated systems may not:

• Misrepresent their identity, purpose, or authority
• Place orders or take actions without the customer’s authorization
• Bypass CAPTCHAs, security measures, rate limits, or access controls
• Improperly copy, scrape, or extract our content or data
• Interfere with the operation or security of the Services
• Impose an unreasonable burden on our website or systems

We may restrict or block automated access that violates these Terms, threatens security, or disrupts our operations.

Nothing in this section prohibits ordinary search-engine indexing or legitimate AI-assisted shopping tools operating through Shopify-supported or otherwise authorized channels.

SECTION 15 - TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 16 – DISCLAIMER OF WARRANTIES

We make reasonable efforts to keep the Services accurate, available, secure, and functioning properly. However, we do not guarantee that access to the website or Services will always be uninterrupted, timely, secure, or error-free.

Information provided through the Services is offered for general informational purposes. We do not guarantee that all information will always be complete, current, or free from errors, although we may correct or update it when appropriate.

Our products should be used in accordance with their labeling, ingredient information, and suggested-use instructions. Because they contain natural food and botanical ingredients, reasonable variations in flavor, color, aroma, texture, and appearance may occur. We do not guarantee that a product will produce any particular health, wellness, taste, or performance outcome, and individual experiences may vary.

Except for warranties expressly provided by us, and to the fullest extent permitted by applicable law, the Services are provided on an “as available” basis without additional express warranties.

Nothing in these Terms excludes or limits:

• Any warranty or consumer right that cannot legally be excluded
• Our responsibility for products that are defective, contaminated, damaged, mislabeled, or otherwise fail to conform to applicable law
• Any remedy available under our Return and Refund Policy
• Liability that cannot legally be disclaimed or limited

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Space of Love Foods and its owners, officers, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of the website or Services, including lost profits, lost revenue, lost savings, or lost data.

For claims arising solely from use of the website, Services, or purchase of a product—and not involving personal injury, illness, death, property damage, fraud, gross negligence, willful misconduct, or rights that cannot legally be waived—our total liability will not exceed the amount you paid for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits liability for:

• Personal injury, illness, death, or property damage caused by negligence or a defective, contaminated, adulterated, damaged, or mislabeled product
• Fraud, gross negligence, reckless conduct, or intentional misconduct
• Obligations expressly provided under our Return and Refund Policy
• Any warranty, remedy, or consumer right that cannot legally be excluded or limited

Some jurisdictions do not allow certain limitations or exclusions of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

SECTION 18 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Space of Love Foods, A New Space of Love Foods, LLC, and our owners, officers, employees, contractors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising directly from:

• Your material breach of these Terms
• Your unlawful, fraudulent, or unauthorized use of the Services
• Customer Content you submit that infringes another person’s rights
• Your intentional interference with the operation or security of the Services

We will provide reasonable notice of an indemnifiable claim and reasonable cooperation in its defense. You may not settle a claim in a way that admits wrongdoing by us or imposes a nonmonetary obligation on us without our written consent.

This section does not require you to indemnify us for claims arising from our negligence, gross negligence, intentional misconduct, violation of law, or a defective, contaminated, adulterated, damaged, or mislabeled product. It also does not apply to conduct by Shopify or another third party that you did not control.

SECTION 19 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. These Terms of Service and any separate agreements through which we provide Services shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles.

Subject to any consumer rights or protections that cannot legally be waived, disputes arising from these Terms or the Services shall be brought in the appropriate state or federal courts serving Yavapai County, Arizona, and you consent to the jurisdiction of those courts.
